A Brazilian judge on December 16 ordered a global ban on Adele’s song Million Years Ago after a Brazilian musician, Toninho Geraes, accused Adele of plagiarizing his song Mulheres to create his hit.

Judge Victor Torres of the 6th Commercial Court in Rio de Janeiro ordered the Brazilian branches of Sony Music Entertainment and Universal Music – Adele’s two record labels – to “immediately and worldwide stop using, reproducing, editing, distributing or selling the song ‘Million Years Ago’ in any form, medium, including streaming or sharing platforms.”

In addition, these record labels could face a fine of up to $8,000 for each act of non-compliance with the ban. However, the companies still have the right to appeal.According to lawyer Fredimio Trotta, representing Brazilian musician Toninho Geraes, Adele’s 2015 song Million Years Ago plagiarized Geraes’ classic samba song “Mulheres” (“Women”), which was performed by Martinho da Vila on his 1995 album.

Geraes is seeking damages for royalties, $160,000 in emotional distress, and recognition as co-author of Adele’s song.

Mr. Trotta also said that this week his legal team will work to notify radio stations, television stations, and streaming services around the world of Brazil’s ruling.

Sony Music Entertainment Brazil said it had no official comment at this time, while Universal Music Brazil did not respond to a request for comment.

In addition to the Brazilian accusations, Adele’s song “Million Years Ago” has also been accused by Turkish music fans of having a similar melody to the song “Acilara Tutunmak”, roughly translated as “Clinging to Pain”, by Kurdish singer Ahmet Kaya, released in 1985.

However, Kaya’s wife, who died in France in 2000, once said it was unlikely that a global star like Adele would do such a thing.

Brazil is a member of the 1886 Berne Convention, an international treaty for the protection of copyright.
